Downstairs tenant complains we are noisy, can we get evicted if young children are just being kids We live in a second floor apartment The tenants above us have kids We hear the kids running, jumping, playing, etc We recently moved in and have not complained because that’s apartment living and we know they have kids and kids make noise. We purchased a condo recently and our upstairs neighbors are a nuisance They are loud (mostly impact noise) and its both a function of both poorly insulated flooring and disrespect I have talked to them 3 times to no avail. I live in an apartment building in miami and since june 2020 my next door neighbor has been playing extremely loud music almost every day and i complained in writing to the management several times by email and text messages and i also called 911 to complain about noise so many times but so far nothing changed My building management did not do anything to stop this neighbor from making. Do i have rights as a tenant with noisy upstairs neighbors Have lived in my apartment a year and have dealt with excessive noise (stomping, running, jumping, pounding, dropping of heavy objects on the floor) coming from above. Can i sue my management company and noisy neighbors to compensate for 6 months of noise harassment I live in a rent stabilized building I get extreme noise from the apartment above us, who are a family of 4, children running, crying, very loud object being thrown etc staring at 5am. We have a 2 year old who does not like to be quiet and our neighbor is calling the cops constantly about us being noisey, and we aren't that loud She calls if we walk to loud, or he runs around during the day. What, exactly, is fixing the noisy neighbors problem; a problem they have, or your problem with the neighbors You would have to prove a breach of the lease terms, or of your quiet enjoyment of your unit.
